Purpose To establish the CDR as a socialist democratic republic and declare the leadership of the working class.


Article 1

The Cerdani Democratic Republic is a socialist state of the proletariat. It is the political organization of the workers in city and country under the guidance of the working class and its Vanguard Marxist-Leninist Party, The Communist Party of Cerdani.

The Capital of the Cerdani Democratic Republic is Berlitow.

The State Flag of the Cerdani Democratic Republic is a rectangle of dark green cloth with a band of white in the middle. In the centre The State Emblem defaces the flag.

The State Emblem of the Cerdani Democratic Republic consists of a Hammer and Compass together. This is surrounded by a wreath of wheat, with a red star at the top.

Article 2

(1) All political power in the Cerdani Democratic Republic is exercised by the proletariat. People are at the centre of all the efforts of the socialist society and its state.

(2) The firm alliance of the working class with the class of the cooperative, the members of the intelligentsia and the other classes of the people, the socialist ownership of means of production, the planning and direction of social development and the most advanced knowledge of science form inviolable foundations of the socialist social order.

(3) The exploitation of man by man is to be eliminated forever. The hands of the people are peculiar to the people. The socialist principle "From each according to their ability, to each according to their need" is to be realized.

(4) The consistency of the political, material and cultural interests of the workers and their collectives with the social requirements is the most important driving force of socialist society.

Article 3

(1) The Cerdani Democratic Republic has a policy of foreign policy which serves peace, socialism, international understanding and security.

(2) In accordance with the principles of socialist internationalism, the Cerdani Democratic Republic cultivates and develops all-round cooperation and friendship with other socialist countries.

(3) The Cerdani Democratic Republic supports the aspirations of the peoples for freedom and independence and, on the basis of equality and mutual respect, maintains cooperation with all states.

(4) The Cerdani Democratic Republic seeks a system of collective security on Urth and a stable peace order in the world. It advocates the general disarmament of nations.

(5) Militaristic and revanchist propaganda in every form, war prophesies and ableist, sexist, racist, homophobic, transphobic, or otherwise discriminatory slurs used to demean an oppressed group of peoples are prohibited and are punished as crimes.

Article 4 – DEFENSE OF THE SOCIALIST MOTHERLAND

(1) Defence of the Socialist Motherland is one of the most important functions of the state, and is the concern of the whole people. In order to defend the gains of socialism, the peaceful labour of the Cerdani people, and the sovereignty and territorial integrity of the state, The Cerdani Democratic Republic maintains armed forces and has the ability to institute universal military service. The duty of The Armed Forces of the Cerdani Democratic Republic to the people is to provide reliable defence of the Socialist Motherland and to be in constant combat readiness, guaranteeing that any aggressor is instantly repulsed.

(2) The Cerdani Democratic Republic will never engage in a war of conquest of an entire nation or use its forces against the freedom of another nation.

(3) The proletariat are allowed to form into militias and other paramilitary groups that serve to protect their socialist property and the worker and peasants state.


Article 5 - Economic Principles, Science, Education and Culture

(1) The economy of the Cerdani Democratic Republic is based on the socialist democratic ownership of the means of production.

(2) The national economy of the Cerdani Democratic Republic serves to strengthen the socialist order, the ever-better pacification of the material and cultural needs of citizens, the development of personality and their socialist social relations.

(3) In the Cerdani Democratic Republic the principle of the planning and management of the national economy as well as all other social areas applies. The economy of the Cerdani Democratic Republic is a socialist planned economy. The economic system of socialism connects the central state planning and management of the basic questions of social development with the self-responsibility of the socialist goods producers and the local state organs.

(4) The determination of the monetary and financial system is a matter for the socialist state. Duties and taxes are levied on the basis of laws determined by the workers.

(5) External trade, including foreign trade and the value added tax, is a state monopoly.

Article 6

(1) Socialist property exists as:

Collective ownership of collective societies, as co-operative collective ownership of working collectives, and as the property of social organizations of the citizens.

(2) Protecting and increasing socialist property is the duty of the socialist state and its citizens.

(3) The personal property of all citizens are guaranteed and protected.

(4) Mines, power stations, dams and large bodies of water, the natural and mineral resources of the homeland base, major industrial enterprises, banks and insurance institutions, public goods, transport routes, means of transport of railways, maritime navigation and aviation, Telecommunication systems are public property.

Article 7

(1) The equipment, machinery, facilities, buildings, artisanal and other socialist cooperatives as well as the livestock of the agricultural production cooperatives and the result obtained from cooperative use of the soil as well as the means of production are cooperative property that are owned by their workers.

Article 8

(1) The soil of the Cerdani Democratic Republic is one of its most precious natural resources. It must be protected and rationally used. Land and forestry land may be deprived of its purpose only with the consent of the responsible authorities.

(2) In the interests of citizens' well-being, the state and society ensure the protection of nature. The protection of the waters and the air as well as the protection of the plant and animal world and the scenic beauty of the home are to be ensured by the competent authorities and, in addition, to every citizen.

Article 9

(1) Science and research as well as the application of their knowledge are the essential basis of socialist society and are supported by the state on all sides.

(2) With the uniform socialist education system, the Cerdani Democratic Republic assures all citizens of a high level of education which is constantly growing in society. It enables citizens to shape socialist society and to participate creatively in the development of socialist democracy.

(3) The Cerdani Democratic Republic promotes secular science and education with the aim of protecting and enriching society and the life of citizens, To master the scientific and technological revolution and to ensure the continuous progress of socialist society.

(4) Any abuse of science directed against peace, international understanding and the life and dignity of all peoples is prohibited.

Article 10

(1) The Cerdani Democratic Republic promotes and protects the socialist culture that serves peace, humanism and the development of the socialist community of people across the world.

(2) The promotion of the arts, the artistic interests and abilities of all workers and the dissemination of artistic works and achievements are protected and encouraged by the state.

(3) Body culture, sport and tourism as elements of socialist culture serve the all-round physical and mental development of citizens.

Article 11 – BASIC RIGHTS & OBLIGATIONS OF CITIZENS

(1) Every citizen of the Cerdani Democratic Republic has the same rights and obligations regardless of their nationality, origin, race, gender, ability, sexuality, religious confession, social background and position. Freedom of conscience and thought are guaranteed. All citizens are equal before the law, government and society.

(2) Man, woman and other gendered people are equally entitled and have the same legal status in all areas of social, state and personal life. The promotion of women and transgender people, especially in professional qualification, is a social and state task.

(3) The youth of the Cerdani Democratic Republic are encouraged by the state in their social and professional development under the idea of, “A new generation for Socialism and Peace.”

Article 12

(1) Every citizen of the Cerdani Democratic Republic has the right to fully participate in the political, economic, social and cultural life of the socialist community and the socialist state under the principle "Work with, plan with, rule with!"

Article 13

(1) Every citizen of the Cerdani Democratic Republic has the right to work. They have the right to a job and free choice according to social requirements and personal qualifications. Citizens have the right to fair pay based on their quality and quantity of work. All citizens have the right to equal pay for equal work.

(2) The right to work is guaranteed by both the state and its people.

Article 14

(1) Every citizen of the Cerdani Democratic Republic has the right to education. The educational centres are open to all citizens. No discrimination is made on any grounds. The uniform socialist education system ensures a continuous socialist education for all citizens.

(2) In the Cerdani Democratic Republic, there is a general twelve-years of school education, which is to be fulfilled by attending the lower class schools and the general polytechnic upper school. In certain cases, upper secondary education may be voluntarily terminated in the institutions of vocational training or the training of the workers. All young people have the right and the duty to learn a profession of their choice.

(3) Special education and training facilities must exist for children and adults with mental and physical impairments.

(4) There is no schooling or education fee at any level. Training subsidies and freedom of learning are granted to any and all.

Article 15

(1) Every citizen of the Cerdani Democratic Republic shall have the right, in accordance with the principles of this Constitution, to freely and publicly express their opinions. This right is not limited by any employment or employment relationship. No one shall be disadvantaged if they make use of this right.

(2) Freedom of the press, broadcasting and television in accordance with the constitution is guaranteed.

(3) Every citizen of the Cerdani Democratic Republic has the right to freedom of thought. This includes professing a religious belief and to perform religious acts in private. Likewise however every citizen has the right to profess anti-religious and atheist beliefs.

Article 16

(1) All citizens have the right to assemble peacefully within the framework of the principles and objectives of the Constitution.

(2) All citizens have the right to protest peacefully within frameworks of the laws and constitution.

Article 17

(1) The personality and freedom of every citizen of the Cerdani Democratic Republic shall be inviolable.

(2) Restrictions are only permissible in connection with criminal acts or that are otherwise legally justified. The rights of such citizens may only be restricted to the extent that this is legally permissible and unavoidable.

(3) In order to protect its freedom and the inviolability of its personality, every citizen has the right to the aid of the state and social organs.

Article 18

(1) Every citizen of the Cerdani Democratic Republic has the right to free movement within the territory of the Cerdani Democratic Republic within the framework of the laws.

Article 19

(1) Every citizen of the Cerdani Democratic Republic shall be entitled to legal protection by the organs of the Cerdani Democratic Republic when staying outside the Cerdani Democratic Republic. (2) No citizen of the Cerdani Democratic Republic may be extradited to a foreign power.

Article 20

(1) Every citizen of the Cerdani Democratic Republic has the right to free time and recreation.

(2) The right to recreation and free time is guaranteed; By the legal limitation of the daily and weekly working hours, by a fully paid annual leave and by the planned expansion of the network of popular and other social recreation and holiday centres.

Article 21

(1) Every citizen of the Cerdani Democratic Republic has the right to the protection of their health, their workplace and basic human rights.

(2) This right is ensured through the systematic improvement of working and living conditions, the maintenance of free universal public health, a comprehensive free social policy, the promotion of body culture, school, popular sport and tourism.

(3) On the basis of a social insurance scheme, in the case of illness and accidents, material security, medical assistance, medicinal products and other medical services shall be granted entirely free.

Article 22

(1) Every citizen of the Cerdani Democratic Republic has the right for care in old age, disability and invalidity.

(2) This right is guaranteed by increasing material, social and cultural care and welfare for old, disabled and invalidated citizens.

Article 23

(1) Every citizen of the Cerdani Democratic Republic has the right to living space for themself and their family according to the economic possibilities and local conditions. The state is obliged to realize this right by the promotion of housing construction, the preservation of existing living space and the public control over the equitable distribution of the housing.

Article 24

(1) Marriage, family and maternity are under the special protection of the state.

(2) This is guaranteed by the equality of all in marriage and family, by the social and state support of citizens in the consolidation and development of their marriage and family.

(3) Parent and child enjoy the special protection of the socialist state. Maternity leave, Special medical care, material and financial support for births, adoptions and child allowances are granted.

(4) It is the right and most important duty of the parents to educate their children to healthy and lifelong, capable and universally educated people, to become state-conscious citizens. The parents are entitled to a close and trusting interaction with the social and state education and training institutions.
