Monarch

CGK-2015:1

Acadeshia is a sovereign nation, governed by its own laws and regulations without interference from any individual, group, body, organisation, government body or government from the outside world. Acadeshia is an Elected Constitutional Executive Monarchy.

As an elected constitutional monarchy there are several major tenets.

  1. The Monarch does not inherit the title or position as Royal Sovereign of the nation. He/She is elected as such to that position by the people.
  2. The Monarch is not the sole authority on the creation, implementation, alteration and abolishment of laws, regulations, declarations and constitutional facets. He/She stands as equal within the House of Commons, also called the Senate.
  3. Though the Monarch is a constitutional figure, he/she has an authoritative position within the national government, and acts as the head of state.

Election

When the previous Monarch dies, resigns, or a motion of no confidence is proposed within the House of Commons (henceforth referred to as HoC), a new Monarch is to be elected.

Proposal

  1. Candidates for the new Monarch may only be drawn from the House of Faculty(henceforth HoF).
  2. The member of the HoF must have served a minimum of 8 years on the HoF in order to be eligible.
    1. Should no member with a service record of 8 years or longer be on the HoF at the time, a former member of the HoF - retired for no longer than 4 years - may be drawn as a candidate.
  3. No more than 4 candidates may be drawn from current and former members of the HoF meeting the service record requirements.
  4. The previous Monarch, in case of a motion of no confidence, may stand for the current election as a fifth candidate.

Electoral Process

  1. Candidates are not allowed to engage in any campaign or public activity for the duration of the election process. This is to prevent any propaganda or personal interference in the process of election.
  2. Candidates are allowed only a single opportunity to ‘promote’ themselves during the Candidate Address 1 week prior to the election. During this speech Candidates address the HoC, stating their goals and ideals for the country and their office.
 a)Should the previous Monarch stand as a fifth candidate, he/she shall not be afforded the Candidate Address.
  1. The Election is to take place no later than 4 weeks after the previous Monarchs passing, resignation, or the proposal of the motion of no confidence.
  2. During a special sitting of the HoC, the Senate will vote for the next Monarch.
  3. On the first of the following month the new Monarch is to be announced.

Position in Government

Head of Government The Monarch is the head of government.

Chair of the House of Commons The Monarch is the Chair of the HoC. He sits at the head of the assemblies and is responsible to maintain order and discipline during assemblies of the HoC.

Responsibilities

As head of the government and chair of the HoC, the Monarch has many responsibilities.

Head of Government

1. The Monarch must act on behalf of Acadeshia as its representative in international matters. This includes - but is not limited to:

 a)  Matters concerning other countries
 b)  Matters concerning international bodies, such as the World Assembly
 c)  Matters concerning regional bodies, such as Ten thousand Islands Treaty Organisation
 d)  Matters concerning terrorist organisations and actions within the international communities

2. The Monarch must act on behalf of the Government as it’s representative in national matters. This includes - but is not limited to:

 a)  National crises
 b)  National events
 c)  National reformation

3. The Monarch must act to ensure motions and laws passed by the HoC. Is enacted in practice and incorporated into the existing structure of government.

Chair of the House of Commons

Assemblies

The Monarch sits at the head of the HoC at its assemblies, wherever it may be. As such he has certain responsibilities.

  1. The Monarch must ensure that assemblies of the HoC proceeds civilly
  2. The Monarch must ensure that discussions and arguments during assemblies of the HoC remains on topic and within the authority of the HoC
  3. The Monarch is responsible for the enactment and the enshrinement of motions and laws passed by the HoC in the Constitution and the Law of the People.

Authority

As head of state the Monarch has several important matters of authority. Head of Government

  1. The Monarch has the authority to admit or dismiss citizens to/from their posts within the government
  2. The Monarch has the authority to overrule the rulings of judges in instances where he deems them to contradict or go against the Constitution.

Chair of the House of Commons

The Monarch acts not only as the Chair of the HoC, but also as a full member of the HoC. The Monarch as all the normal authority of any other member, but also carries certain special authorities.

  1. The Monarch has the authority to silence any member of the HoC, should he determine the member to be out of line in his comments, or to be speaking out of turn and without proper recognition.
  2. The Monarch has the authority to either enact and enshrine, or to reject any motion or law passed by the HoC.
  3. The Monarch has the authority to make alterations to any motion or law passed by the HoC before enacting and enshrining it in the Constitution or the Law of the People, provided the alteration does not change the central tenets of the motion or law.

Limitations of Authority

Chair of the House of Commons

  1. The Monarch does not have the authority to make alterations to a motion or law that he/she has him/herself proposed during an assembly of the Hoc. The Monarch must pass such a motion or law as-is when passed by the HoC.
