Limitations on Freedom of Speech Act

LPE-2015:1

It is illegal for an individual, group, body or organisation to make statements, either verbally or in any typed(1) or expressed(2) form that:

  1.  Incites Violence, or Actions that go against a Motion or Law Enacted and Enshrined in either the Constitution or the Law of the People.
  2.  Is derogatory or offensive in either it’s nature or intent towards any individual, group, body or organisation or any of their ideals, convictions, actions or beliefs - whether the target of these statements is a citizen or based in the country or not.
  3.  Spreads - directly or indirectly - or serves to further the existence of, false or unfounded rumours, perceptions or ideas of any individual, group, body or organisation or any of their ideals, convictions, actions or beliefs - whether the target of these statements is a citizen or based in the country or not.


To do so is a major offence and is punishable by law.

Punishments:

Individual

  1. Fine *
  2. Imprisonment for up to and including, but not exceeding, a period of 5 years in a low security prison.*

Group, Body or Organisation

  1. Fine *
  2. Imprisonment of all members aware of and in active participation in the offence for up to and including, but not exceeding a period of 5 years in a low security prison.*
  3. Disbandment of the group, body or organisation.*

1. Any typed work, whether it appear in printed or digital form, on any public publication, document or script within or outside the country.

2. Any form of art or media, including - but not limited to:

 a)  Music
 b)  Statues
 c)  Paintings
 d)  Sketches
 e)  Performances
 f)  Videos
 g)  Soundtracks
  • Falls to the discretion of the presiding judge to determine the conditions, period of time or size of the fine.
